民團:先訂監督規範 再審服貿

〔記者蘇芳禾/台北報導〕兩岸服務貿易協議最快在三月中旬進入逐條審查,不過學者、民間團體都認為,應先制訂監督條例等相關規範,立法院才有資格審查服貿協議。民進黨團總召柯建銘更直言,服貿通過機率趨近於零,請社會大眾不用擔心。

對此,國民黨政策會執行長林鴻池表示,立法權不能凌駕行政權。依據兩岸人民關係條例,兩岸簽署協議,涉及需要修法的條文就送立法院,沒有涉及修法者送立法院備查即可。

立法院將於三月十日前完成服貿協議最後一場公聽會,之後展開逐條審查。台灣守護民主平台、反黑箱服貿民主陣線昨舉辦「兩岸協議國會監督法制化」座談會,討論兩岸簽署協議的各種法律問題。也邀請朝野立委參加,到場的有民進黨團總召柯建銘、民進黨中國事務部主任洪財隆、台聯立委賴政昌、周倪安。國民黨拒絕出席,親民黨因行程不克參加。

中研院法律所副研究員黃國昌發言指出,他曾在公聽會上質疑,立法院是依據哪一條法律來審查服貿協議,全立法院竟沒有人知道。他表示,在沒完成立法前,立法院「喬」出來的審查規則,都不是人民可接受的,也不是民主法治國家的常態。

民主陣線召集人、律師賴中強則舉兩岸於二○○八、二○○九年簽署的海運、空運補充協議指出,當時馬政府原指兩岸航運互免營利事業所得稅、營業稅不涉及修法,後來國稅局卻認定「欠缺法律執行依據」,最後直到二○一○年才在立法院三讀通過,這個案例足以說明馬政府對於「是否涉及法律修正」完全是恣意認定。賴中強也建議,可仿效中國與韓國簽署FTA作法,針對超敏感產品設下二十年的調適期;或是附上生效條件,例如要求中國簽署聯合國兩人權公約後,才可開放廣告業等技術性暫緩之手段。

柯建銘指出,國民黨如果敢將服貿強行送出委員會,後果一定會非常嚴重,「就是硬碰硬」。賴振昌表示,台聯認為立法院不應在監督協議簽署的法規訂定前進行審查。

The fruit cake has been perfectly preserved since the wedding reception at Buckingham Palace.

The lavish four-tier cake, that stood at 9ft tall, was split between 2,000 guests who celebrated the marriage of Princess Elizabeth and Philip Mountbatten. The 3.5 ins by 7.5 ins slice was given to one of the couple’s guards of honour at the wedding ceremony at Westminster Abbey.

Looking dazed and sunburned, U.S. endurance swimmer Diana Nyad walked ashore Monday, becoming the first person to swim from Cuba to Florida without the help of a shark cage.

Despite being home to about 16,000 tree species, just 227 "hyperdominant" species account for half of Amazonia’s total trees, a study suggests.

An international team of researchers found that the region was, in total, home to an estimated 390 billion trees. Writing in Science, they added that the rarest 11,000 species made up only 0.12% of tree cover.

The results were based on a survey of 1,170 plots and half-a-million trees across the six-million-square-kilometre area, often described as the lungs of the world.

The New York City is putting the heat on rogue delivery bicyclists, who have been shirking the new commercial cycling rules — issuing nearly 3,000 violations in less than four months, authorities said.

The legislation went into effect at the end of April and since then the Department of Transportation has issued nearly $300,000 in violations to city businesses.

Workers who postpone retirement are less likely to develop Alzheimer’s disease and other forms of dementia known to affect the elderly than those who leave their jobs at age 60, a recent survey of nearly half a million European retirees shows.

The study looked at health and insurance records of more than 429,000 former workers in France and found that the risk of developing dementia declined with each additional year worked beyond an average retirement age, said Carole Dufouil, research director at INSERM, a French government agency in charge of the study.

A British member of the European Parliament has been temporarily disowned by his right-wing party after referring to a room of party delegates on Friday as ``sluts.’’

A Turkish man has staged an eight-hour silent vigil on Istanbul’s Taksim Square, scene of violent clashes between police and anti-government protesters in recent weeks, inspiring hundreds of others to follow his lead.

A Pakistani show that gives away babies on live television is causing controversy among viewers for turning children into prizes, but the creators say it’s a good deed that makes parents happy.

The Kelly family had a relaxing Sunday morning breakfast, but apparently they didn’t clean up as well as they initially thought. According to NBC-2, a bit of bacon grease was still on the campground grill, and that was enough to draw the attention of a bear.

One in four Australians believe humans co-existed with dinosaurs while one in three think it takes just one day for the Earth to orbit the sun, according to a "worrying" survey published Wednesday.

Like many in food-loving France, Jerome and Marylin are serious about what goes on their plates -- tired of factory-farmed goods and pricey organic foods.

Symantec’s annual Norton Report shows the cost of cyber crime in Australia plunged from $1.65bn last year to just over $1bn this year, as criminals skimmed smaller amounts in online fraud.

中國近年自認已經崛起,野心外露,與周邊國家領土主權爭執不斷,各國反彈,越南連日發生民眾反中抗議,演變成群眾暴動,台灣廠商遭池魚之殃,損失不輕。這一事件顯示,與中國牽扯不清,台灣遭殃。因此,除了協助受害台商,政府當前要務,應如當地業者所強調,明顯區隔台灣、中國,以免我在海外投資無端遭牽連。

馬英九政府什麼事都敢做,唯獨與中國區隔的事絕對不敢。相反地,它千方百計,要把台灣推向與中國統合之路,不論經濟整合或政治終極統一。就此而言,我國駐美國代表沈呂巡日前在華府一項研討會,以「歐盟模式」描繪台灣與中國關係現狀,不但誤導世人,也凸顯馬政府睜眼說瞎話的本性。

「歐盟模式」由沈呂巡提出,尤其惡質。眾所周知,歐盟從一九五一年僅六個成員國的歐洲煤鋼共同體,發展至今為二十八國的國際組織,兩年前且因「促進歐洲和平、和解、民主、人權」獲頒諾貝爾和平獎,有若干值得注意的特質。

首先,它是民主國家與市場經濟體的結合,參與國家在政經方面都須符合此一屬性。其次,歐盟成員國或有大小之分,彼此間卻是獨立的國與國關係,且具體表現於它有二十四種正式官方語言,開會文件同時齊備。另外,各國有自由參加的權利,通常由公民投票決定,已加入也可選擇退出,沒有強迫。

沈呂巡當過我國駐歐盟代表,不會不知歐盟這些基本特性。馬英九早已宣稱「台海兩岸不是國與國關係」,根本否定「歐盟模式」適用雙方關係。如今,駐美代表居然拿「歐盟模式」與兩岸關係相提並論,尤其馬政府所推動的中國政策,顯然企圖魚目混珠。
以國家屬性來說,中國既非民主國家,也不是市場經濟體,實施的其實是權貴資本主義。這種政經體制與「歐盟模式」完全不相容。相形之下,台灣政治民主、經濟自由,馬政府卻強要我國與它統合,只會害慘台灣。

更關鍵的雙邊關係,中國表面上說「沒有誰吃掉誰的問題」,但從來沒有鬆動併吞台灣的野心,國際打壓尤不遺餘力,我國參加國際組織、與經貿夥伴洽簽協議,一概圍堵。這與歐盟各國之間平等尊嚴自主往來,大相逕庭。

基本屬性既然南轅北轍,馬政府上任以來加速與中國融合,尤其現在進行式的服貿協議、自由經濟示範區,完全不顧台灣利益。它的中國政策不得民心,卻一味蠻幹,要國會充當橡皮圖章,激起了太陽花學運,如今又拿「歐盟模式」自我臉上貼金,令人厭惡。

沈呂巡為推銷他所謂「歐盟模式」,還舉例台灣是中國最大外資來源,有最多航班飛往中國,對中國深入瞭解,並有「無比的影響力」,雙邊受益。這真是比癡人說夢還嚴重的胡說,不值一一駁斥。僅以大量投資中國為例,台灣因此導致經濟成長遲滯、產業斷鏈且轉型無力、就業流失、薪資不漲等重重困境,至今難解。經濟既受制台海彼岸,中國以商逼政、以經促統形勢已成,台灣深受其害。

尤有甚者,馬政府不但加碼開放科技、金融西進,還對中國門戶洞開。以開放中國觀光客為例,接團、餐飲、住宿、交通、採購,中國都利益由自己人賺,台灣賺了來客人數,卻陷於白忙而鮮少實益;最近為擴大接待自由行中國客,更引發澎湖嵵裡海岸等破壞生態環境開發爭議。情況如果持續,中國客改變香港社會,使其原有特色漸失的弊害,即將上演台灣版。

沈呂巡提「歐盟模式」,被立委批「毫無常識」,不合常識而大言不慚,顯示說者別有用心,只是拿它來遮掩馬政府不得人心的賣台政策。不過,沈呂巡不是始作俑者,馬英九口中的「經濟發展總設計師」蕭萬長才是。這位大官當年倡言「兩岸共同市場」,擔任副總統後,以「六三三」經濟空頭支票留下笑柄,同樣「毫無常識」也不現實的「兩岸共同市場」,也是導致經濟受制中國的幫凶。


台灣與中國,經濟市場不能「共同」,連日事件再顯示,國家認同尤「共同」不得。

〔記者林良哲、林惠琴/綜合報導〕蠶豆症患者接觸樟腦丸、蠶豆,會誘發症狀,台中市陳姓女子為清除蟑螂,在社區空地放置樟腦丸,王姓住戶因兒子罹患蠶豆症,拜託她別再放了,陳女反而愈放愈多,還斥「蠶豆症是父母造孽!」王某憤而提告,檢方依妨害名譽罪將陳女起訴。
  
婦挨批欠缺同理心
陳女不體諒蠶豆症患者的言行,「中華民國先天及代謝疾病關懷之友協會」昨表示,顯然她十分欠缺同理心,若是自己家人不幸罹患蠶豆症,陳女會做出這種行徑嗎?對於特殊疾病患者,民眾應將心比心,政府也要宣導正確觀念,以免類似事件重演。

不聽勸 愈放愈多
起訴書指出,陳姓女子(34歲)住在龍井一處集合式住宅,她為了清除住家及社區蟑螂,今年2月間在空地放置樟腦丸,王姓男住戶因兒子罹患蠶豆症,請陳女的女兒代為轉告,希望她別在公共區域放置樟腦丸,以免其子引發併發症。

王姓住戶說,樟腦丸發出的特殊氣味,會讓蠶豆症患者出現黃疸精神不佳,嚴重時會出現呼吸急促、腎臟衰竭,甚至休克而有生命危險,希望陳女體諒。

陳女不但不同意,反而愈放愈多,甚至在2戶交界處一座流理台的水龍頭上,故意懸掛大量樟腦丸,王姓住戶無計可施,只好拜託社區管委會及警方處理,讓雙方調解。

調解過程中,陳女居然在眾人面前指「蠶豆症是父母造孽!」王姓住戶憤憤不平,認為陳女分明是在眾人面前,指控他和妻素行不良、作惡多端,因果報應下,使兒子罹患蠶豆症,遂委託律師提告。

檢方偵辦時,陳女雖承認說過此話,但辯稱並非故意,也沒有妨害名譽犯意;但檢方依據現場錄音光碟,認為陳女之言已屬於負面指摘,足以毀損對方社會評價,依妨害名譽罪嫌將她起訴。



蠶豆症為遺傳 忌碰蠶豆樟腦丸

〔記者蔡淑媛/台中報導〕中國醫藥大學附設醫院血液腫瘤科主任巫康熙指出,蠶豆症是遺傳疾病,台灣每百個新生兒有3個罹患,9成為男性,如果接觸到樟腦丸、蠶豆或阿斯匹靈等含有氧化物的物質,患者會導致溶血症

溶血症會出現貧血、黃疸,臉色蒼白、皮膚變黃,要靠輸血治療才能好轉,嚴重的話會造成腎臟衰竭、休克等。蠶豆症患者應避免樟腦丸、蠶豆,以免誘發。

巫康熙說,蠶豆症患者透過新生兒篩檢就能發現,不過也曾發生一名新生兒罹患蠶豆症,父親是醫生、母親是護士卻都沒發現,帶孩子到戶外玩,當地常放樟腦驅蚊,接觸到樟腦引發溶血症,造成腦性麻痺。

以中國在南海設置鑽油平台為導火線,在越南所發動的示威抗議,演變成反華暴動,意外讓台商成為主要受害者,企業損失比中國還鉅大。這件近年罕見、牽涉國人生命財產安全的重大外交事件,同時觸及台越關係,台中關係,RCEP的真相,三者的核心,則是中國政經政策,政府在此出現了致命性的錯誤。
台商在越南的投資受到嚴重衝擊、甚至多年心血付之一炬,根據返國台商陸續的口述,對於越南官方的態度,透露出尚待確認的詭異。台商成為目標,存在兩種可能,一是看到中國字,一起遭殃;二是外資在當地的剝削問題,併隨反華一同爆發。
不論成因究竟,事後的政府處置能力,最是關鍵。當台灣已經獲知平陽、河靜等地的情形慘烈之際,我駐河內代表處、外交部、國安會,這條決策線的因應,不但慢半拍,更似乎狀況外,導致台商怨聲載道,同時也演成外交交涉的混亂,儼然「無祖國」狀態。
如此表現,令深知台越關係深厚的人莫不詫異。過去,儘管與中國建有正式邦交,越南總理府內有個台辦,專案處理與台灣的實質往來,絕不致有今天找不到門路施壓的窘境,顯然,我們駐外單位的螺絲釘完全鬆脫了。何以致之?孟子說:「無敵國外患者,國恆亡」,應是對外交休兵政策的最適詮釋。
不再把兩岸關係的現實,置放在政策評估的首位,後果就是前線鬆懈,後方斷線。再加上,這六年來,全部的政經經營重心就是中國,從兩岸直航到服貿已簽有十九項協議,不僅南向分散投資的計畫,缺乏政府後盾支援,台灣與東協各國的關係強化,也受到資源排擠與顯著弱化。如今,徵兆不就在逐步浮現?
從這裡,必須一併檢討這些年政府百般念咒的口號,「透過中國,才能連接RCEP與TPP」。後者,已經被美國政府幾度打槍,TPP與中國無關。這次的越南反中示威,更凸顯了中國近年向南中國海的宣示主權動作,在這個區域內所引發的高度緊繃,越南並非單例。

馬英九主張:台灣與中國連結,一起參與RCEP的邏輯,現在看來,無比諷刺。越南人分不清台灣與中國有什麼奇怪?這個教訓,應可告訴所有台灣人,錯誤的國家發展方向,如果無法因民意的認知而獲得矯正,受害的將是人民自己,關在台北冷氣房裡的爺們,除了束手無策,他們還會什麼?

〔記者楊政郡/台中報導〕請鬼拿藥單!牙科診所老闆陳男與妻子談離婚,2人的資產有上億元,陳男被妻子查到婚外情,擔心自己一半財產也被妻子拿走,為了保住一半財產,陳男竟與吳姓徵信業者共謀偽造5000多萬元假債務,不料吳假戲真做,把假債權以786萬元轉讓第三人,陳情急自首並控告吳,陳被依偽造文書判4月,吳多吃1條侵占罪判6月徒刑。

徵信業者判刑6
判決書指出,陳某夫妻開設牙科診所,98年間夫妻感情破裂,陳被妻子抓到婚外情,協議離婚,陳擔心財產全被妻子拿走,找上吳姓徵信業者,一方面調查妻子是否有外遇,一方面找吳男當人頭。

陳結算與妻約有上億元資產,因此製造5460萬元假債務,開6張本票及1張借據,由吳擔任假債權人,陳支付法院裁定費,且由吳向法院聲請本票裁定,做得像真的一樣。
此案經過1年多,1004月,這些假本票及法院裁定還在吳的手上,吳因積欠游男債務,竟以786萬元將上述假債權轉讓給游男,游男也立即向法院聲請強制執行,陳驚覺事態嚴重,向地檢署自首。

吳供稱,這是假債權沒錯,都是陳自己的主意,裁定費也是他出的,而陳說要給他人頭費200萬元,卻只給30萬元就沒下文,陳也沒有主動向他索取本票,他才會把本票及裁定轉讓給游姓債主。

法官認為陳、吳2人是偽造文書共犯,吳另觸犯侵占罪,審酌2人都沒有前科,判陳4月、吳6月徒刑,得易科罰金。

【律師說法】假債強制執行 去了了

〔記者楊政郡/台中報導〕律師李學鏞指出,為了討回欠款,債權人可以拿證據到法院聲請支付命令,每件規費500元,法官視拿出的證據,審查後給予民事裁定書並通知債務人,債務人如無異議,一段時間後就可以聲請強制執行,強制執行費用為執行標的物千分之8,如對方有財產就可以執行拍賣,如果對方有異議,就會進入訴訟。
李學鏞說,本案是債權、債務雙方共謀製作假債權,有本票及借據為證,法官「形式」審查後給予裁定書,陳某一定不會有異議,這種裁定變成「確定裁定」,也就是所有的人都會認為這是有效的債權,且經法院裁定,只要陳某名下有財產,隨時可進行查封及拍賣,所以吳某轉售會有人要。

強制執行不受訴訟影響
李學鏞表示,以往常有「借名登記」、甚至朋友託孤情事,一句話就搞定,但最近這類「弄假成真」案例頻傳,陳某要回頭證明這是「假債權」,還要經過訴訟,而上述民事裁定可直接強制執行,且強制執行不受訴訟影響,等訴訟確定是假債權,可能一切都來不及了。

A big new study says as the world gets warmer, people are more prone to get hot under the collar. Scientists found that aggressive acts like violent crimes and wars become more likely with each added degree.

Results showed that subjects who drank about three cups of water (775 milliliters) before taking a battery of cognitive tests performed better on a test measuring reaction time than subjects who didn’t drink water.
